1. Acceptance of Terms

By accessing or using ViralAI (the "Platform"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ViralAI ("Company," "we," "us," or "our").

Important: You must be at least 13 years old to use this Platform. If you are under 18, you must have parental or guardian consent.

2. Description of Services

ViralAI provides an AI-powered platform for creating viral video content. Our services include:

  • AI Image Generation: Generate 4 candidate images from uploaded reference videos
  • AI Video Generation: Create short-form videos (up to 5 seconds) based on your prompts and selected images
  • Content Library: Store and manage your generated content
  • Subscription Plans: Access to varying levels of credits and features

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must use Google authentication to create and access your account
  • One person or entity may maintain only one account

3.2 Account Responsibilities

  • You are solely responsible for all activities conducted through your account
  • You must immediately notify us of any unauthorized access or security breach
  • You may not share, sell, or transfer your account to another person
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payment

4.1 Subscription Plans

  • Basic Plan: $49.99/month - 30 credits
  • Pro Plan: $299/month - 300 credits

4.2 Credits System

  • Image Generation: 1 credit per request (generates 4 images)
  • Video Generation: 2 credits per video
  • Credits are valid for the duration of your active subscription
  • Unused credits expire at the end of each billing period
  • Credits cannot be transferred, refunded, or carried over to the next billing period

4.3 Payment Terms

  • All payments are processed securely through Stripe
  • Subscriptions are billed monthly in advance
  • Automatic renewal unless canceled before the next billing date
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice

4.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings or Stripe Customer Portal
  • Upon cancellation, you retain access until the end of the current billing period
  • No refunds will be provided for partial months or unused credits
  • Only one subscription is allowed per account; you cannot create multiple subscriptions

Note: If you cancel your subscription, all unused credits will be forfeited at the end of your billing period. Make sure to use your credits before canceling.

5. Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or offensive
  • Infringe upon intellectual property rights of others
  • Use the Platform to create deepfakes or misleading content without proper disclosure
  • Attempt to bypass, disable, or interfere with security features
  • Use automated systems (bots, scripts) to access the Platform without authorization
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Platform for commercial purposes without a proper license
  • Share or resell generated content in violation of applicable laws

6. User Content and Ownership

6.1 Your Content

You retain ownership of all content you upload to the Platform ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and process your content solely for the purpose of providing our services.

6.2 Generated Content

You own the rights to content generated by our AI based on your inputs ("Generated Content"), subject to these Terms. However:

  • You are solely responsible for ensuring your use of Generated Content complies with applicable laws
  • You must not claim the Generated Content was created entirely by you without AI assistance
  • We may use anonymized, aggregated data from Generated Content to improve our AI models
  • You may not use Generated Content in ways that violate third-party rights or our Acceptable Use Policy

6.3 Content Restrictions

  • You must have the right to upload and use all User Content
  • You must not upload content containing copyrighted material without permission
  • We reserve the right to remove any content that violates these Terms
  • We are not responsible for the accuracy, quality, or legality of User Content or Generated Content

7. Intellectual Property Rights

The Platform, including its design, features, software, and all related intellectual property, is owned by ViralAI and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission. Unauthorized use may result in legal action.

All trademarks, service marks, and logos used on the Platform are the property of their respective owners.

8. Prohibited Activities

The following activities are strictly prohibited:

  • Illegal Content: Creating content that violates any law or regulation
  • Harassment: Using the Platform to harass, bully, or threaten others
  • Impersonation: Impersonating any person or entity
  • Spam: Sending unsolicited messages or engaging in spam activities
  • Malware: Uploading or distributing viruses, malware, or harmful code
  • Unauthorized Access: Attempting to access accounts, systems, or data without authorization
  • Data Mining: Extracting data from the Platform using automated means
  • Abuse: Abusing our support team or engaging in fraudulent activities

Violation of these prohibitions may result in immediate account termination and legal action.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

  • Your access to the Platform will be immediately revoked
  • All unused credits will be forfeited
  • Your User Content and Generated Content may be deleted
  • No refunds will be provided for partial months or unused services

9.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms or our Acceptable Use Policy
  • Fraudulent, abusive, or illegal activities
  • Non-payment of fees
  • Extended periods of inactivity
  • Any reason at our sole discretion

9.3 Effect of Termination

Upon termination, all rights and licenses granted to you will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

  • The Platform will be error-free, secure, or uninterrupted
  • Generated Content will meet your expectations or requirements
  • AI models will produce accurate or appropriate results
  • Your content will be preserved indefinitely

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Important: Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ViralAI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with:

  • Your access to or use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your User Content or Generated Content
  • Any harm caused to third parties through your use of the Platform

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Platform shall be resolved through:

  • Informal Resolution: First, contact us to attempt to resolve the dispute informally
  • Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
  • Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions

12.3 Jurisdiction

You agree to submit to the personal jurisdiction of the state and federal courts located in California for any actions not subject to arbitration.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you via email for significant changes
  • Display a notice on the Platform
  • Provide a 30-day notice period for material changes

Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform and cancel your account.

Additional Provisions

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver: Our failure to enforce any right or provision will not constitute a waiver of that right or provision.

Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
